America's affordable housing crisis has forced states throughout the nation to rethink the balance between statewide and local control of zoning. In a growing number of states, legislators have introduced bills to restrict or remove local government powers to use zoning in ways that limit the production of new housing units. States like Colorado, Montana, and California have already adopted significant zoning reforms, while many additional states like New York, Minnesota, and Michigan are still debating what changes would best balance state and local interests in controlling housing development. This presentation reviews adopted and proposed statewide zoning reform legislation, the political strategies used to find successful state-local compromises, legal challenges to adopted legislation, and the practical challenges of implementing adopted zoning reforms.
